“Under the influence” is a police matter

Under the influence is a police matter, but initial detention can be by any designated marine official. In his latest article, Andrew Oliver, a senior partner in our Marine and Commercial Fisheries Team, provides advice on an issue that all too sadly is becoming more of a frequent problem across the fishing industry.

The misuse of drugs is unfortunately becoming more prevalent in the fishing industry, both in terms of use by crew as well as those in charge of vessels, including skippers.

Recent events, including several different videos of incidents happening at sea, have highlighted a degree of uncertainty about the exact rules in force regarding the law and how it is enforced, both at sea, and when vessels have finally made it ashore.
